Terms of Service

  1. The following Terms of Service set out the legal rights and obligations in relation to the services provided by Storm Fitness Academy Ltd. Storm Fitness Academy Ltd reserves the right to amend these terms of service at any time. Every time you enrol with us or make a purchase, please check these Terms to ensure you understand the terms which will apply at that time. Qualifications

Our qualifications are delivered online and/or via blended learning, a combination of face to face workshops, online learning, and live webinars. Candidates who successfully complete all of their learning assessments are awarded either diplomas or certification credentials that are widely recognised in the UK and other countries. The qualifications are recognised by the Chartered Institute for the Management of Sport and Physical Activity (“CIMSPA”), and the Register of Exercise Professionals (REPs).

Coaching

Our coaching services are delivered online and/or via a combination of face-to-face workshops, online learning, and live webinars.

Study portal

Our study portal requires that you have a good internet connection and basic literacy and IT skills. Our downloadable assignments are produced in Microsoft word. You don’t need Microsoft Word as many word processing programmes are compatible with Microsoft word. However, if you experience any formatting errors, we recommend using Microsoft word.

Workshops

Our workshops, designed by the Storm Fitness Academy Team, are opportunities to learn from more experienced trainers and network with other fitness professionals. Attendees can be provided with a REPs-endorsed e-certificate upon completion of your workshop.

Enrolment and assessment

  1. You must provide evidence that you meet all of the entry requirements for the course. You understand that if you do not provide us with these or your prerequisites do not meet the awarding body’s specifications, you cannot be formally assessed or certificated at the end of your course.
  2. You have the right to appeal any assessment decision or make a complaint if you so desire, see our appeals and complaints procedure HERE.
  3. You must complete all your work to the best of your ability and within specific deadlines. You have a maximum of 12 months from the date of enrolment to complete all qualifications you enrol on. You are responsible for monitoring and ensuring you meet your course enrolment deadline.
  4. If you have opted for online-only delivery, you understand that you will need to video and upload your practical assessments for your assessor to observe remotely.
  5. Our office hours are Monday to Friday from 9 am to 4 pm (closed on bank holidays). We will endeavour to answer any enquiries out of those hours on the next working day.
  6. Storm Fitness Academy reserves the right to change the training venue, delivery model, and/or your tutor if necessary.
  7. You may contact your tutor/assessor via email, but please do not ask for their personal mobile numbers.

Certification

  1. We endeavour to mark/assess all submitted assignment portfolios within ten working days of submission.
  2. Once all your qualification assignments have been assessed and passed, they will then be forwarded to our internal verifier, who will second mark/assess all of your assignments within 10 working days of when she receives them.
  3. If your assignments successfully pass internal verification, we will then certificate you with the awarding body, who may also request to mark/assess your assignments again (third marking).
  4. Once all your assignments have been passed by the assessor, internal verifier and external verifier, you will be certificated. We will keep you informed throughout the process
  5. This timeline from submitting your last assignment to receiving your certificate can take up to 10 weeks.

Additional Charges

  1. The name and address you enter onto your course enrolment form is the name and address used to process your certificate. Failure to inform us of any changes may incur an additional certification and postage charge of £30.
  2. For each course you enrol in, Storm Fitness Academy will allow, free of charge, 1 (one) re-assessment of each assignment you submit. For any subsequent re-assessments, you will be charged £20 per re-submission.
  3. Assessors can answer questions and signposts towards additional learning resources but cannot provisionally mark or review assignments before submission.
  4. For subsequent re-assessment of worksheets, Storm Fitness Academy will not commence any re-assessment activity until all due re-assessment fees have been paid in full.
  5. Additional one-to-one support is charged at £40 per hour, we must receive a minimum of 24 hours’ notice for any rescheduling or cancellation, or you will be charged full price for the booking.
  6. You will not be certified at the end of your course if there are unpaid invoices on your account.

Cancelling goods and services

  1. Your right to cancel an order for any products or services starts when you place your order and ends 14 days from the day you receive your goods or have accessed your learning materials.
  2. You will get a refund within 14 days of Storm Fitness Academy receiving your learning materials or providing evidence of having returned them (for example, a proof of postage receipt from the post office), whichever is the sooner.
    1. By enrolling on your course you agree that the digital content will be made available to you immediately. You give your explicit consent for the supply of the course to begin within the fourteen day cooling off period and you acknowledge that once you access any part of the course content you will lose your right to cancel under the Consumer Contracts Regulations.

Payment plans

If you are paying your course fees via a payment plan, the following terms apply:

  • Late Payment Fee: A charge of £12.00 will be applied on each occasion your payment is late or missed.
  • Declined or Recalled Payments: If you make payment by debit, credit, or charge card and the payment is subsequently declined or recalled, a £12.00 fee will also be applied on each occurrence.
  • Interest on Overdue Amounts: Interest will accrue on overdue amounts at a rate of 1.5% per month (18% per annum) from the date the payment was due until the date it is made. This is in compliance with the Late Payment of Commercial Debts (Interest) Act 1998, where applicable, and aligns with the Consumer Rights Act 2015 for fairness in consumer transactions.
  • Legal Commitment: By opting to purchase our course through a payment plan, you acknowledge and agree that:
    • You are entering into a legally binding agreement to pay the full course fee as outlined in the payment schedule.
    • This commitment remains in effect regardless of whether you choose to complete the course or withdraw from it.
  • Suspension of Services: In the event of late or missed payments, we reserve the right to suspend or withhold access to the course or any associated services until the overdue balance is fully settled, as permitted under the Consumer Rights Act 2015.
  • Payment Plan Changes: Should any changes to the payment plan be agreed, a non-refundable administrative fee of £30 will apply.

  • Debt Recovery Failure to make payments in accordance with the agreed payment plan may result in further action to recover the outstanding balance. Where applicable and as set out in these Terms, late payment fees and interest may be applied to overdue amounts.

    If a payment remains unpaid for more than 30 days, we reserve the right to take steps to recover the outstanding balance. This may include referral to a third party debt recovery agency or the issue of a claim through the County Court.

    Before commencing legal proceedings, we will normally attempt to contact you and may issue a formal demand or letter before action in line with the relevant pre action protocols.

    Where we engage a third party debt recovery agency or incur court fees or legal costs in connection with the recovery of overdue sums, you agree to reimburse reasonable and proportionate costs, to the extent that such costs are permitted under applicable UK consumer law. Any interest charged will be applied in accordance with these Terms and, where relevant, applicable legislation.
